Including Public and Private Sectors: Allocating 5% of Jobs for “People with Disabilities” in Yemen

The Ministry of Social Affairs and Labor in the Yemeni government issued a ministerial circular today mandating the compulsory activation of the employment percentage for persons with disabilities across both the public and private sectors in Yemen.
The circular emphasized the commitment of government agencies and units of the public and mixed sectors to allocate a percentage of (5%) of the total vacant positions for persons with disabilities who hold qualification certificates.
The Ministry of Social Affairs also obligated private sector employers to employ no less than (5%) of their total workforce from among those with disabilities, in accordance with their abilities and potential, while ensuring they enjoy all rights and benefits established in the Labor Law without any discrimination.
The circular included a number of regulatory measures to facilitate the employment of persons with disabilities, including the nomination and employment mechanism and the opening of special records for them at workplaces. Additionally, it obligated relevant authorities to notify the Ministry of the data of those appointed within a maximum period of one month from the date of appointment.
It confirmed that the Ministry’s offices in the governorates will carry out periodic inspection campaigns to ensure compliance with the employment percentage and take legal measures against violators.
The circular stated that allocating an employment percentage for people with disabilities is in implementation of the provisions of the Care and Rehabilitation of the Disabled Law No. (61) of 1999, which enhances the integration of this group into the labor market and enables them to exercise their legal rights and participate effectively in the development process.
